1. Bookings and Contract Formation

1.1 A booking is confirmed only once:

• Full payment has been received; and
• All required booking forms have been completed.

1.2 All participants must read, agree to, and sign a waiver prior to participating.

1.3 The person making the booking is the Lead Name. The Lead Name:

• Confirms authority to accept these Terms on behalf of all participants;
• Confirms that all participants have been made aware of these Terms;
• Acts as primary contact for all communications.

2. Cancellations, Transfers, Insurance, and Minimum Numbers

2.1 Cancellations by the Client (Day Events)

• More than 4 weeks before the event start date: Full refund, minus a £20 administration fee (a reasonable pre-estimate of administrative costs).
• Less than 4 weeks before the event start date: No refund.

2.2 Transfers and Credit Notes

• Bookings may be transferred to another participant at any time, provided full contact details are given.
• Up to 4 weeks prior to the event, bookings may be transferred to another date or converted into a credit note.
• Within 4 weeks of the event, transfers are only permitted if a replacement participant can be found. Proof of the replacement may be required.

2.3 Cancellations by Peaky Finders – Weather / Extreme Circumstances

Peaky Finders may cancel or reschedule events due to circumstances beyond our reasonable control (including extreme weather, illness, safety concerns, or government restrictions).

Where this occurs, participants will be offered one of the following:

• Transfer to an alternative date for the same event;
• Transfer to an alternative event of equivalent value; or
• A credit note valid for 12 months from the original event date.

If none of these options are reasonably suitable, a refund of monies paid may be requested, excluding any costs already incurred by Peaky Finders which cannot reasonably be recovered.

2.4 Cancellations by Peaky Finders – Other Reasons

For cancellations not due to weather or extreme circumstances, participants may choose:

• Transfer to another date;
• Transfer to an alternative event of equivalent value;
• Voucher for future use at the same value; or
• Full refund.

2.5 Minimum Participant Numbers (Group Hikes)

Certain events require a minimum number of participants. If minimum numbers are not met:

• Participants will be notified at least 4 days in advance;
• An alternative date will be offered, or a full refund if the alternative is unsuitable.

2.6 Insurance

Peaky Finders is not responsible for any additional costs incurred as a result of cancellation, including travel, accommodation, or food.
Participants are strongly advised to hold personal accident and travel insurance.

3. Risk, Liability, and Participant Responsibility

3.1 Inherent Risk

Outdoor activities carry inherent risks, including slips, trips, falls, adverse weather, rough terrain, and personal injury. Participation is at your own risk.

3.2 Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability which cannot be excluded by law.

3.3 Fitness and Safety

Participants must ensure they are medically and physically capable of completing the event.
Peaky Finders reserves the right to refuse or terminate participation if:

• Safety risks arise that could not reasonably have been foreseen; or
• Relevant medical information was not disclosed.

3.4 Behaviour

Participants must follow the instructions of the Group Leader at all times. Peaky Finders reserves the right to terminate participation without refund where behaviour is unsafe, disruptive, illegal, threatening, or under the influence of alcohol or drugs.

3.5 Leaving the Group

Responsibility ceases once a participant voluntarily leaves the organised group against advice.

3.6 Property

Peaky Finders is not liable for loss or damage to personal property, including vehicles, money, clothing, or equipment.

4. Terrain and Route Changes

Events may involve uneven, rocky, muddy, or slippery terrain, steep ascents/descents, farms, livestock, rivers, woodland, hills, moorland, or mountainous terrain. Routes may be changed or terminated due to weather, group pace, fitness, or safety concerns. The Group Leader’s decision is final.

5. Children and Parental Responsibility

Participants under 18 must be accompanied by a parent or legal guardian over 18, who accepts full responsibility for their safety, behaviour, and supervision.

6. Photography and Media

Photos and videos may be taken for promotional purposes. Participants may withdraw consent at any time. Parental consent will be obtained for minors.

7. Intellectual Property

All content on the website, including logos and materials, is protected by intellectual property law. No use, reproduction, or distribution is permitted without written consent.

8. Dogs

Dogs are permitted on day hikes only with prior approval. They must be well-behaved, sociable, and kept on a lead when required. Non-compliance may result in refusal to participate without refund.

9. Medical Conditions

Participants must notify Peaky Finders of any medical condition that may affect their safety or the safety of others, including asthma, diabetes, heart conditions, or allergies.

10. Transport

Unless stated, transport is not included. Peaky Finders is not liable for third-party transport cancellations or changes.

11. Hiking Weekend Breaks

• Deposit: 25% non-refundable at booking.
• Balance: Must be paid by the due date; late payment may result in cancellation, with deposit retained.
• Minimum participants: If the minimum is not reached 4 weeks before the event, the event may be cancelled and refunded.
• Cancellation charges:
  • More than 57 days: Loss of deposit
  • 29–57 days: 60% of total cost
  • 0–28 days: 100% of total cost
• Cancellation charges represent a genuine pre-estimate of loss incurred by Peaky Finders.

12. Amendments

Peaky Finders may amend these Terms at any time. Changes do not affect existing bookings, except where required by law or safety/operational reasons. Continued use of the website or services constitutes acceptance of updated Terms.
